I would like to know if HP Bluestone 8 can be used commercially?

Yes - full commercial deployment is allowed with no fees. I've been evaluating it since release and it's looking good.

Is there any legal reference document you can refer me to? I am thinking about using it commercially. Why use JBoss if HP is free and better (supporting clustering).

Yes HP Application Server 8.0 (HPAS 8.0) is available for free -- even for commercial use, even for Integration use.
Check out the HPAS FAQ. Also look at page 3 of this data sheet it says:
To encourage and jumpstart application development on this exciting platform, HP-AS is being distributed FREE OF LICENSING CHARGE for development AND production use
You can contact an HP Sales Representitve for further information: hpmdinfo@hp.com
And if there are any more questions you have about HPAS 8.0, I'll do my best to answer them.

Free support is available through our listservs. You can also purchase support agreements.
The HPAS 8.0 Resilient Pack is available for a cost of $5,000. The Resilient Pack includes things such as JMS support, persistent state management, xa-compliant JDBC drivers (Merant), and multi-database transaction service.

Resilient Pack is pretty cheap App server compared to it's commercial counter-parts.
Do you know how this server is in terms of performance, maintainance, clustering, security and is it J2EE certified?

As far as I know, we haven't published any data on Performance, but I've heard good things... and its not yet J2EE certified. I'd try posting your other question to the HPSERVER-TALK listserv, there a lots of developers and other users on the listserv, hopefully you can get a better answer regarding security etc there.
