Translation Phase of JSP - Doubt

In translation phase of JSP, JSP Engine validates syntax of Tags used.

1. Duplicate variables in a single translation unit -> It passes the translation phase but fails @ compilation phase.

2. Declaration of same bean a single translation unit -> It fails @ translation time only.

Why case 1 & 2 are behaving differently ?
