Parsing attribute "xsi:nil"

Hi,
I am hosting a webservice on Sun ONE Application Server 7.0.0_01.
The xsd for query message mentions following :
<xs:element ref="prefix:tagName" nillable="true"/>
When a query is sent to the server with a SOAP message with following syntax : <prefix:tagName xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance"; xsi:nil="true" xsi:schemaLocation="xsd uri"/>
The server while validating the query message throws the following error :
java.lang.Exception: org.xml.sax.SAXParseException: s4s-att-not-allowed: Attribute 'nillable' cannot appear in element 'element'.
Can anyone please suggest a solution?
