H1B consultant asking for money.

I have been given offer by one consultant for H1B.

But here are some queries.
They are asking me to pay money before filing my visa. But some of my friend in US told me that those consultant who are asking for money before filing are almost frauds. But i have no clue how to know these facts .

Can anyone please help on this issue ? That what aal things we need to really consider ?

Yes, they're are frauds. They rip off H-1B workers, but in return they sponsor you for Visa and Green Card (they will ask you to pay $10,000+ for the whole process).

However, currently there are many illegal aliens who're desperate to stay in the U.S. and actually pay them for the Visa.

Remember, just because your H1 is being filed doesnt mean that its going to be approved. If you pay the consultant a large sum before the visa is actually approved, what refund guarantee does the consultant give you?

I know for sure, it is unethical to take money. It can also be illegal.

Fraud or not, but would you pay money to any consultant before filing for your visa? What if your H1 is not approved, what if your visa was not approved after H1 approval and what if consultant is not able to find job for you once you are in US, can you tell if things didnt work out, consultant will give your money back?. Would you take that risk?

In any case asking for money before or after filing H1 just shows that they are hungry for money and wont really care for you or your career. I would personally doubt their intentions. Consultants are suppose to pay you money, not the other way around.

If they don't give you specific and valid reasons, YES. Many have used the H1-B visa and the vast majority do not pay these fees. It's the Consulting firm's duty to fulfill the legalities required by the DOL, make you the offer, file for the petition and then when approved, send you onsite depending on your business needs. Asking money upfront makes me suspicious.

The reason consultant is that they will under loss if i leave them before 1 year as they are spending lot of money on me. I have seen some of my friends have given security money but they gave only after approval of VISA.

The way a friend's company used to do it is: You sign a contract in which you accept to pay the money back if you leave the company. Most of the time, after one year you are entitled to leave without reimbursing the money. In works the same way with tuition and other things they spent on you.

I think you should not give them any money, it really sounds like a scam. In the other hand, if they offer you a contract, read it many many many times with a knowledgeable lawyer.

Frankly, I do not buy that. These are normal risks that any decent company must take if it has to remain attractive. Other than the plane tickets, it is incumbent upon the Consulting firm to cough up the visa fees. You must consider the following factors: Are they referring to the security money in the Contract itself? If not, then you are relying on their goodwill to return you the money after the contract period. Do you really wish to spend time chasing these guys and tracking your money/visa status? You will get the best answers if you enquire from people working at this firm and who have already gone through what you plan to go through.

I know for sure most of H1B consultant ask for security deposit because in the past candidate used to accept offers from o more than one consultants, submit their papers to more than one consultants. And obviously can go with only one consultant and rest loose their investment on the candidates. These H1B consultants are not big companies so they can not afford losses. Few candidates even refused to go to US after visa is processed saying they have some personal issues because of which they can not shift to US. This way consultant loose money. By taking security deposit they are sure about the candidate. But they do not ask complete processing fees. They ask around 60-70K Rs.
