I got a call from a Chennai based consultant who said there were vacancies in a US based firm called Sysmind.He said the company needs to urgently fill their positions and for this they would also be filing for visas for the candidates.He also said that I would have to pay a security deposit of 1000$ (approx. Rs.50000) which he stated was because the company would have to bear the expense if the candidate backs out after getting the visa.Also he says that the company is recruiting people by just looking at the current organisations they are working on and if they are in a reputed company then they are just asking for copies of their passport and other documents and applying for visa.He said the visa will be got in 3-4 days and then soon we may have to fly.I have just asked him to mail all the details so that I can get some more info.I would like to know from fellow ranchers if this could be a fake.I forgot the Chennai Consultancy name.I would go through the mail he sent today and post the name today itself.Meanwhile friends give your inputs too.

Are you kidding which visa are u going on... even if its B1 this is surely fake... u need months to file ur H1 or B1...

No way it is possible for any kind of visa.

only a tourist visa can take that little time.
Sounds like a scam operation, trying to lure people into paying money for jobs in the US and then being sent over on a visum without an attached work permit.

No one can get visa in 3-4 days, even if its tourist visa, it will take long time. Since in India, you will have to get an appointment and as my friends told, if you apply now you will be getting an appointment only in August or in September.

So better check with him to see what he tells.

Well the consultant's name is Foghorn Consulting(at least that is what is the name given in the email I received.The mail format though looks somewhat fishy(lots of grammatical and broken sentences and looks like some copy paste and editing job).Regarding the visa in 3-4 days thing I think I heard him saying something to this effect...I will ask the guy if he calls me(I am sure he will because there is money in it for him!!).

I believe you might have heard wrong.If you are interested in coming USA nothing wrong to pay 1000$. Now a days most of consulting company asks as a security as H1 b fees is high and they all are not fake. You only need to careful and get some more idea about the company.

I called a friend through my company and they took security deposit of 1700$.

Well I think he meant that your visa application will be submitted to USCIS in 3-4 days. And that is possible. But getting your visa application processed and approved takes longer time. Even if he applies for fast track (premium) processing, it takes 15 calendar days to get a result and mind you after 15 calendar days, you (your H1B sponserer) will know whether your application was approved or not. Assuming your visa application is approved, you can fly to USA and start working only in october. But in all probability, he is not applying for a premium processing (1000 $$ extra !!) and hence it will take anywhere from 90 to 180 days for the processing and after that you have to wait atleast a month in India to get an appointment for your visa interview. So that means you are looking at the end of this year.
Also H1B quota for this year is almost over. On an average 1500 visa applications are getting filed every day. and till 25th May USCIS received about 50K application. Source: (http://www.uscis.gov/graphics/services/tempbenefits/cap.htm)
So unless you file in next 2-3 days, it will be tough to get through the gate this time.

weird, here you could (when we still needed it) get a tourist visa to the US by simply walking up to the nearest US consulate or the embassy and waiting a few hours until we got to the head of the queue...

Hello Nikhil,

I am the Managing Director of FogHorn and I chanced upon your post regarding the H1B issue.
Everything about the opportunity was genuine, As there were only 3-4 days left for H1B Cap, we decide to do some reverse engineering and select people who were from good educational background/work experience ... invite them to make a commitment , file the visa quickly and then go through all the regular processes including technical interviews.

It was very unfortunate that the cap was reached before we could file the visa's. In any case, there will again be opportunities in a few months time

I wish you had visited us in Chennai or had someone you know come and meet us. One meeting would have put all your fears to rest. Sometimes it is better to do things the old fashioned way.

I have also sent a personal mail to your rediff address with complete contact information.

So it was a hoax. You offered to send in the application paperwork in 3-4 days, but stated you would supply the visum in 3-4 days.
Of course the entire hiring process would likely take a lot longer than that if you're for real and not just interested in pocketing the cash and running with it, leaving the candidates out of a job and out of a thousand dollars.

If you are reasonably aware of the H1B process, you will know that everything is driven by the visa cap. We never took/take a single $ from any candidate. They were supposed to pay that directly to the employer(Sysmind) as a security deposit just in case they decided not to pursue the opportunity after the visa(work permit) was processed. It was also explicitly mentioned that this would be refunded in thier first paycheck when they reported for work in Sysmind NJ office.

There was absolutely no statement or claim by our recruiters that the visa would be processed in 3-4 days. We did ask the candidates to make up their mind quickly as time was running out with the cap(and it did).

The H1B is such a well known process in India that I am even surprised Nikhil misunderstood. For the record Nikhil's candidature was never even forwarded to our client and we procesed a total of three candidates against this engagement.

Before using the kind of harsh language you have, I would strongly recommend you learn some basics of how this business works and at least take a look at the people and standing of the two organizations involved. Sysmind has over a 100 technical personnel on staff in the US and there has never been one complaint/lawsuit of wrong-doing. FogHorn is a very reputed MNC and we are retained/paid by our clients (for specific staffing engagements.)The candidates are never charged anything... ever!. These clients our amongst top names in the IT industry and we go through a whole bunch of validations and audits to become a certified vendor. We also have our own technology practise and BPO operations.

I have entered this forum to defend our reputation especially while dealing with ignorant and opinionated folks like yourself.

Bala,

On one hand, kudos. It is very nice of you to come to the water-hole, talk to us about your organization and set the record strainght. If only more of our Indian companies showed a similar degree of professionalism and responsiveness, our industry would do much better.

On the other hand, it doesnt go down well to call one of our members "ignorant and opinionated" - that goes against our "be nice" rule. It is you who has a point to prove (and business to lose) - harsh words won't win you any friends.

I agree with the previous poster. It is extremely nice to see you come out in the open to clarify your position. Jeroen is entitled to his views just as you are entitled to yours. I have studied Jeroen's views and just as with others, I agree/disagree with his views on different matters. He definitely takes a strong position and you should contest his position/views and not attack him. I too am a part of a recruiting team in one of the parts suppliers in Detroit. And I have seen for myself how a good program like the H1-B is being circumvented by some companies. And the locals are justified in being concerned as it could impact their jobs. We in India too are no different. So, this being a sensitive issue, I think you should be careful and restrained in your words while defending yourself against any attack.

Thanks Nikhil. As you may understand use of word like "scam" and "running away with thousands of $$$" really touched a very raw nerve. After having worked in various "staffing" organizations in the US I returned to India to set up a "high integrity"organization.

The mail was pretty much same as my first "post"and I had sent it to you via the "Ranch" send email tab.

That is understandable. Unfortunately, when Jeroen speaks, he speaks for himself. But when you post on behalf of the company, your company too comes to the picture and hence you will be judged more harshly. It's the same as when a common man explodes over an issue and when a leader explodes in parliament.

Anand, I disagree. When in the forum you are an individual and speak up about broad ranging stuff that concerns a lot of people. H1b issues do concern a lot of us and it is not fair to target a company that I represent without giving equal opportunity to rebut.

Also this is not about business loss or gain for me, it is about individual integrity.

I rest my case and trust others will do the same.
