severance question

i was laid off recently and offered a generous severance package of about 8 months. One of conditions in severance i signed, specifies that the severeance pay will stop if i got hired by another company. Luckily, I was quickly able to find a job in less than 20 days and new employer willing to sponser h1 visa. Can you tell me what will happen to my severance pay? How will the old employer know about my new job? I'm thinking there is no way for them to figure this easily and i can keep new job and severance pay.

Please provide your experience and thoughts.

That would be fraud, and it's posssible that your new company may not want you around either after you're convicted of that. Not to mention the INS, who may not want to let a convicted felon stay in the country at all. And also not to mention your friends and family, who may not like having a felon around either. Those are pretty big risks to take for money that's rightfully not yours and which you shouldn't need since you have a new job, don't you think?

Caveat: I do not under any circumstances support fraud... but...

In a side discussion with a friend in the legal department, of a large corporation, who shall remain nameless, many many years ago... I was told that the section on "returning severance" was mostly part of the boilerplate. And quite frankly, she wouldn't know what to do, if someone did try to return the severance...
