Hi all,

My question is , Can anyone get an H1B , if his company applies after MAY this year ?
The reaason I am asking this is ,I have heard that H1B applications are to be filled in the month of april only and after this no applications would be entertained. Is this true ? Does executive H1B comes to rescue in this case or, that is something else?

For the 2006-2007 year, the open category 65K H1B's quota was filled late May. For the special higher education category 20k quota, it was filled sometime in July (if memory serves me right).

The quotas I mentioned are for accepting applications. Once the quota is filled, no more applications are entertained. For 2006-2007, I personally know people who filed in May and their application was accepted.

Can anyone enter US on H1B , applying after MAY? I mean can companies reserve quota and use those later in the year.

Let me get to my question in detail.

I have an offer from a company to join them in a months time and they will process my H1B as the requirement is for US.But I want to complete my current project and that will get over by June and I do not want to quit this before.I have talked to my friends , they said that the quota for H1B will not take much time to get finisned and to best of my knowledge H1B is the correct way to go.So it I want to fly this year then I have quite my current job immediately. So I was looking for some alternate(like executive H1B) , if any.
I am in a confused state.

Rahul,

As far as I know, even if you apply by May, the process will take atleast 3-4 months unless you have filed in permium processing. But still you can enter US only in Oct 01. So even if your visa is approved, you cannot enter or start working US before that.

Hope this clarifys your question.

Let me elabotare my question again.

Say , I do not apply for H1B in this april and then I decide to apply (after the quota closes) ,can I do so? Is there is any other way I can enter US (not in B1 offcourse) ?

AFAIK

I do not think there is any other special way to get H1. I think someone also mentioned about the Master's degree quota. But may be you can try for L1, which I think is all year round.

Thank you Vjy Chin.
Few more queries more:

1> Is there is any pay difference for L1 holders and H1B holders.I mean can a L1 holder draw en equal salary as an H1B of same experience.

2> What is the expected salary for an 3 years experienced J2EE professional in the state of CA , AZ , or any web link throwing light on this.

Rahul,

The salary should not be that much different between the 2. One problem might be, in L1, you cannot shift your employer, but in H1 you can change your employer.

Regarding salary in those states, I am not sure. You can check salary.com, yahoo hotjobs salary section to get a rough idea about the salary in those parts.

Hope this helps.
