Tricky question regarding H1B.

Hi all,

I was thinking of something related to H1B , so thought of sharing this with ranchers.Any help will be appreciated.

If a person is working in some company , say X and in the month of march he/she decides to quit his job for a company ,say Y ,which would process his/her H1B.But the previous employer (X) has two months notice period.

So my question is ; can the second company Y start processing when the employee is still working in company X?

I guess answer is NO. Why because there is no guarantee that you will be joining the new company Y. But it may dependent on the company.

But without joining what is the use of an H1B.I think H1B is employee + Company.Is not it ?

It is similar to what a consultant/body shopper do. They will apply H1B even you are not a employee. But big companies may not apply your H1B till you don't join them.

Its possible for company Y to file H1B while you are working for company X

employee can transfer his/her h1b to company 'Y' w/o giving notice to 'X'. Once the visa is x'fered (which takes hardly 2 days), then employee can give notice to 'X'. Don't give notice to 'X' before x'fering visa, as 'X' can cancel your visa.
Also , after 2 mths , if employee don't join 'Y' , 'Y' can cancel that visa.
Also if employee wants to join company 'Z' w/o joining 'Y', he/she can do that w/o any hurdle & w/o giving any idea to 'Y' as 'Y' can cancel that visa .

Here the person under consideration is not having h1b.

Hey is it true, what prasad kulkarni has said ?? I heard H1-B can only be transferred to a new company when you are at onsite (like, after you go onsite, join a US firm or client and transfer your H1 visa) !!! Can a person transfer his H1-B from x company to 'Y' company when at offshore (like a company which is located in India, to another company which is located in India) ? I believe what prasad has said, is only for onsite transfer !! Is it not ?

How can a company 'Y' transfer the visa (H1) arranged by company 'X' without the knowledge of 'X'. Dosen't 'X' get atleast a mail ?
