Hi,

I am working for a major Services based Software company in Bangalore, India.I have got a valid H1 B petition from this company which is valid till Sep 2008.My doubt is if I decide to quit my present employer, will my H1B visa be still valid?
Also in case I need to get any transfers of my visa what is the procedure for the same?

Thanks in advance,
Sumit Ranjan

Hi Guys,

Can someone please respond to this query ASAP ? Also, just to make it more clearer, I have never travelled to US on this H1B visa.

Thanks in advance for your replies,
Sumit

H1B visas are bound to a specific company. If you leave the company, it's no longer valid. At that point I think you have about 60 days to leave the country.

Your new company will apply for the visa to be transferred.

It depends on where you are based:- If you are based in US, then you can transfer the visa, ie, a fresh petition can be filed for you by a different organization and you are eligible to start working for them as soon as the petition is applied for, and a receipt is obtained. On the other hand if you are in India and have never been to US on H1-B visa, then you are not eligible to transfer the visa. In the latter case, you have to first get the visa stamped from your present employer and go to USA and then only you can transfer that visa.
