Notice Period issues

I work for a software firm in Hyderabad and have 3 years of experience as a Java developer...Now the job market has been little encouraging after a significant gloomy period..I am thinking of a change and have been receving calls for oppurtunities lately.
The bad part of it is every body wants me to join with in 15 days or max by 1 month..I am a billable resource and my management will hardly be flexible on notice period since they need to lose a billable resource or get a resource on board with in that 1 month both which are highly unlikely..

If I resign and try to negotiate with my management and my prospective employer I am at risk of loosing existing job should my efforts are not successful on both fronts...

This has been biggest problem I am facing these days

The new employers ought to be aware of people's notice periods.

It looks they are aware and I tell them as well..But perhaps due to the immediate requirement or whatever, they insist on joining well before the norm..They themselves have 2 months of notice period, but they want experienced candidates (again therefore candidates who need to serve the notice period in yet another organisation) who can join with in 15 Days ! !

You could discuss the problem with your old employer. But I think the new employers are messing you about.

Oh, I've had worse. I recently received a mail from a consultant about a job opportunity for people with 3+ years of experience and he wanted me to join in a weeks time!!!

Week shmeek . Negotiate with them about the joining date. If they are not flexible then it is not likely to work out so leave it. Here is a horror story I heard from the HR's mouth

An employee wanted to leave the current firm and join a new one. The notice period was 2 months. The company told him that it was ok to leave in 2 months and after about a months time, refused to let him go. Yes you heard that right. This employee can now not join the next company and is left in a bad position at his current work place.

In another incident, an employee was simply told he cannot leave with a shorter notice period just so the company could stifle his new employment opportunity.

If the new company will not negotiate the joining date, remember that you will be walking on knives during the transition period. Leave your current employment only when you are sure that you can join the next company on time. If one of the parties is acting funny, be on your guard.

I think I am already doomed here. I am negotiating with my new employer for the end/mid of next month. Even assuming they agree and my present firm if doesnot relieve me by then, I have lost the both - I already resigned from existing firm and may be unsuccessful in joining my next employer as per their expectations...Now I should prepare my self to be jobless from December ending till I find a new job..May be out of inexperience I didnot strongly negotiate with next employer.. I should have denied the offer..Now I am the looser on both fronts..

What would happen if you left before the notice period ends?
How is the answer different in the US market?

In most cases you will not receive an experience letter, which is required by the next employer

If you have more than one possible future employer, then it's time to stop being their pawn and assert yourself. If the company that's offering to hire you isn't willing to make the concession of waiting a reasonable length of time, then they don't really value that much. Meaning that you can expect less respect, and less job security than you would at a firm that's willing to treat you as a truly valuable resource.

Then again, if you're that valuable, you would probably do well negotiating with your current employer. You might find that they're willing to make some improvements. After all, it would be cheaper than hiring a replacement.

Hi,

Don't panic. Be bold.

If you have the mail copy of your resignation letter , just forward it to your new company HR.

Also, forward them the mail which shows the acceptance of your resignation from your present manager.

So that, the new company confirmly knows that you are ready to join them.

Also, you try to keep in touch with the new company HR. Explain them the situation. Always be cool. Convince them .

Finally, try to be patient and cool with your current manager. Agree to whatever he tells to you (like a cat you should behave).
Daily follow up with the present manager for your earlier relieval.
