Not completely sure of the point here. You are not really getting extra questions. The test is timed for a specific number of questions -- so it is not like you are getting less time.
And it is statistical. Everyone has to answer 60 questions in a set time; nobody knows which questions are valid; so it is fair.

There is a difference between knowing how "difficult" a question is, to knowing the pass/fail rate for a question. You can easily insert a question into the test based on the difficulty, but you need the later (pass/fail rate), before you can fairly incorporate (ie. score) the question for the test.
