double standard in US

this story just broke today. a young man in Arizona was sent a letter saying he owed 15,000 + 10% interest in back child support and medical bills(they are garnishing all his wages). it was the result of an encounter he had with a 20 year old woman when he was 14. the woman never informed him and had the child who is now 6 years old. I think she waited until the statute of limitations on statutory rape ran out, then she filed for welfare.

most of the people on the talk show were appalled as was I. one though, said that he thought the guy shouldn't pay the back stuff because he didn't know about it, but he thought he should have to pay from now on because he didn't report the crime(he enjoyed it).

I couldn't believe he said that. if I had sex with a 14 year old girl and she really enjoyed it, and I got caught, she could appear in court and say she loved me, wanted to marry me etc. and I would still get a 20 year sentence.

I think some lawyer will offer his help for this kid because IMO it is outrageous.

If the guy were charged with crimes against a minor, I think that analogy would apply. As Randall depicts it, someone is being held liable for a decision that he did not have a hand in.

A minor cannot consent, so I don't have a problem with that. Now the double standard applies when a 14 year old boy has sex with an older woman. You would never see the hue and cry for that situation that you would for the opposite. Men, even those underage, are assumed to be the aggressor.

Having had some experience with the child services bureaucracy, I will simply say that no matter what the issue at hand is, the father is automatically assumed to be guilty and liable.

What I was saying is if guys are being sent up the river for things they did in the 70s, then why is this woman not subject to prosecution for doing the same thing only six years ago. If she was subject to prosecution I doubt she would have ever come forward, rendering everything else moot.

The courts generally seem to think that an underage boy having sex with an adult female either initiated or at the very least consented, thus nullifying the statutory rape charge.

Re: catholic priests - since it was male-to-male contact, the belief is that the child was unwilling - or at least was coerced into the act. It is also considered to be different if it is an authority figure (i.e. priest, teacher, scout troop leader) vs. just a person they knew.

I am not defending anybody's position, just stating what I believe to be true.

Woah! I read that story totally backwards (that HE was the elder). I see what you are saying. The statute of limitations varies from state to state and the guy at the center of this story says he didn't then and doesn't now want to pursue charges so it's probably moot.
In the Church scandal, many charges were dropped because the cases were old (see John Geoghan). The Church may have paid civil penalties for aiding and abetting paedophile priests in the 70's, but it looks like if the case was old, the priests themselves were not charged.

Yeah the more I think about it the more it sounds like he's getting what he's asking for. He doesn't object to child support going forward but just doesn't want to pay back support. He wants to pick and choose instead of just fighting the whole insane thing,

I would fight the judgment that I had any obligation, and then if I wanted to pay child support I would just send a check of my own free will.
