Is SimpleTag Spec Violated in IBM Websphere Application Server6.0

I am using simple custom tag handler.Inside doTag i am invoking JSPBody.
I am declaring body content as empty in TLD
I am invoking JSP with custom tag with body.

it compiles correctly and it even executes body correctly .

but Spec says Tag should not be allowed to call with body and setJSPBody should not be called.

this is working as per spec in Tomcat but not in IBM application server 6.0 or RAD 6.0

please help
