can not use classic compiler error

Hi All,
I am running tomcat 4.1.27 on win2K machine. I've jdk1.3.1_09 intstalled on it.
I am able to start tomcat successfully. But when I try to run a jsp page I am getting error :
Cannot use classic compiler, as it is not available. A common solution is to set the environment variable JAVA_HOME to your jdk directory.
I've JAVA_HOME set to C:\jdk1.3.1_09
what am I missing here?
