Can't create "persistence" dir

I can run the -install ok, but when doing
java -jar orion.jar
for the 1st time, I get the following error:
Fatal Error: Transaction log file (/C:/orion/persistence/transaction.state) did not exist and was not possible to create, the most common reason for this is an invalid path or Orion lacking security to write to that path: C:\orion\persistence\transaction.state (The system cannot find the path specified)
I'm on a windows 2000 machine with all the latest ms updates. My user sign-on has admin privelege. I also tried signing on as administrator, but no luck.
If I manually create the persistence dir, then try again , I'm fine.
The reason I would like to fix this is because of quirky behaviour ie. the jsp examles run ok, but the news app does not. My friend can run the same news app, and it runs fine. He can also run our app ok on his pc, but it will only run in the default dir for me. I've re-installed several times, and set the xml files accordingly. I also tried the beta orion.

He may have an older version of Orion. Do you mean that you have to create the persistance directory more than once?

We've run into this in more recent versions, but once the dir is created, the problem vanishes.

I just have to create the persistance dir once, then I'm fine. The only reason I'm concerned is that I'm also having problems with some other apps like the sample news app, and an app that a friend of mine and I are developing. He can run it in a dir other than the default, but I can't. He also did not have the persistance dir problem and can run the news app ok. I guess I'm following that old computer maxim: fix the first problem first and often the subsequent problems will disappear.
I've tried the current version 1.5.2, and the beta 1.5.3 with the same result. My friend is running 1.5.2.
 
Don't get me started about those stupid light bulbs.
