hi

there are many diffrences between H1b and L1.L1 is a long term visa
and H1B is of 3 years extended to 6 years.L1 primarily is of 7 extendable of course.
in L1 your wife can work in H1B your wife cannot work.

L1 guys definitely have work rights in US than any other and more salary.



Politically correct statement would be to say that your spouse can work.

Just saying that your "wife" can work , assumes that "fairer sex" doesn't usually work and hang around with husband.

Hello everybody.

I am on H1B for company X. Visa for company X and I-94 are valid till - Oct 2008.

Company Y is ready to file for h1 transfer. My questions are:

If h1 transfer to company B is approved then
1> Do I need to go back to my home country to get my visa stamped? In other words, do I need to attend Interview at US Consulate in Home Country for stamping.

2> New H1 approval is sent along with new i-94, right? If so, will my current I-94 become invalid?

3> What if new H1 approval is sent (but with no i-94)..do I need to leave country and re-enter (possibly from home country or Canada), to have valid I-94?

Any help appreciated.

Answers:

1) No. You do not need to go back to India .
2) I -94 is issued at the port on entry and will be valid irrespective of whether you are working for X Y or Z company.
3) You do not need to .

To cut the long story short . H1 Transfer doesn't mean that a new Visa is going to be issued .. Your counsel / employer / lawyer will take care of everything . I can say this as I have done the same few months back .

They are equal to Job title and reflects the role you are playing.

Salary is also tightly coupled with your Job Band .

B - Software Engineer
C - Programmer Analyst
D - Program Manager

I understand that H1 is currently being mis-used ( and it's unfortunate ). But at the same time , what about the people who come on H1 from India with sufficient years of exp behind them . Are we going to tighten the law , pick up bad apples OR put a blanket ban on all the H1 from developing nations ( I use this word instead of third world ).

Sorry for using the "R" word , I was carried away!

Second, why are you bringing up H-1B aliens from Third World countries, when there are tens of thousands of H-1B and other non-immigrant aliens from First World countries who insist on excellent benefits and pay?



What exactly you mean by bringing H1B from first world nations. Doesn't it prove that you are biased ( or racist to certain extent ..)

Everybody in the world should get equal opportunity irrespective of ethicity,region or anything else. Only criteria should be "whether you are good for the Job ?" . Period.

Moreover, if few body shoppers are doing something which is illegal you can not generalize to the whole population..

That's an interesting observation. I would like to know if it comes within the purview of equal opportunity employer ?

Another thing , I know it didn't happen in my case , but won't it will come as a poaching case ( client poaching employees from vendor ).

My new company was a client for my old company and I used to interact with them. One day , they offered me the job and I took it.

Anothe suggestion for you: Try in companies like Wipro / CTS . They recruit from US ( as US employee ) and pay better than what they pay to some one whom they have recruited in India..My friend got an offer from CTS (USD 80 K PA ) . Kewl.
